TERMS & CONDITIONS

1. Overview

The present Terms and Conditions constitute the contractual agreement between Sail & Stay Privé (“the Company”, “We”, “Our”, “Us”) and the customer (“You”, “Your”, “Passenger”, “Guest”), governing the booking and participation in our sailing and accommodation experiences.

By confirming a booking, the customer acknowledges and agrees to these Terms and Conditions.

2. Booking Process

2.1. Direct Booking

A booking is considered confirmed only upon receipt of the required down payment and a written confirmation from Sail & Stay Privé. The booking agreement becomes binding once the payment is processed.

2.2. Booking via Third-Party Providers

Customers booking through third-party providers (e.g., travel agents, booking platforms) remain subject to these Terms and Conditions. In case of discrepancies between third-party terms and those of Sail & Stay Privé, these Terms take precedence.

Offers and provisional reservations do not guarantee availability until the required payment is received and confirmed in writing.

2.3. Trip Planning Deposit

To begin the trip-planning process and the preparation of personalised itineraries and offers, the Company may request a refundable deposit of EUR 500.

The deposit is fully refundable at any time until the customer accepts a formal offer and a booking is confirmed under Section 3 (Payments). Once the customer approves an official offer and proceeds with the first instalment, the EUR 500 deposit will be credited towards the final trip price.

If the customer chooses not to proceed with a booking, the deposit will be refunded in full. No further claims or compensation may be made.

3. Payments

To secure a booking, the customer must pay a first instalment of 20% or 40% of the total price, as specified in the official offer.

  • For multi-day trips with long lead times, the first instalment is generally 20%.

  • For day trips and short-term charters, the first instalment is generally 40%.

A second instalment (if applicable) and the remaining balance are due according to the payment schedule provided in the official offer.

Full payment must be completed no later than 30 days before departure. For bookings made less than 30 days before departure, full payment is required at the time of booking.

The payment schedule in the official offer shall prevail in case of discrepancies.

Payments can be made via bank transfer or online by credit card. For day trips, cash payment is possible for bookings made 5 days or less before departure.

4. Costs

The booking price includes all services and provisions specified in your selected package. Any items not expressly listed, such as onshore meals, personal expenses, or optional activities, remain the responsibility of the client.

For multi-day trips, prices may include an Advance Provisioning Allowance (APA), which is a pre-paid amount covering operational costs such as fuel, port fees, and provisioning. The APA is managed transparently by Sail & Stay Privé, with any differences settled at the end of the trip. Any unused APA balance will be refunded at the end of the trip. Overages beyond the prepaid APA are payable by the client at settlement. APA transactions are final and non-refundable once expenses are incurred.

5. Cancellation Policy

5.1. Cancellation by the Customer

a) Multi-Day Trips

Until the full balance due date: The down payment (40% of the total price) is non-refundable.

Up to 30 days before departure: 50% of the total price is due.

Less than 30 days before departure: 100% of the total price is due.

Failure to show up on the day of departure, or more than two (2) hours after the scheduled embarkation time without prior notice, will be considered a cancellation by the client, and the full amount will be due.

b) Day Trips

31+ days before departure: The down payment (40% of the total price) is non-refundable.

15 to 30 days before departure: 50% of the total price is due.

1 to 15 days before departure: 100% of the total price is due.

Failure to show up on the day of departure, or more than two (2) hours after the scheduled start time without prior notice, will be considered a cancellation by the client, and the full amount will be due.

Clients may transfer their booking to a replacement guest, subject to prior written approval from the Company. Refunds or liabilities are limited to amounts actually paid to Sail & Stay Privé; the Company is not liable for consequential losses (e.g., flights, hotels)

5.2. Cancellation by Sail & Stay Privé

If the company cancels a trip, customers can choose between:

  1. Rescheduling at no additional cost.

  2. A full refund.

5.3. Force Majeure

In cases of force majeure, the Company will issue a voucher worth up to 100% of the total amount paid, valid for future bookings, subject to operational feasibility.

6. Amendments

6.1. Amendments by the Customer

Customers wishing to change a booking must notify Sail & Stay Privé in writing. Any amendments are subject to availability and may incur an administration fee.

6.2. Amendments by Sail & Stay Privé

  • The Company reserves the right to replace the vessel with an equivalent one if necessary.

  • The Company may replace crew members without affecting the trip price or entitling customers to refunds.

  • Check-in times are as stated in the booking agreement but may be adjusted without compensation.

Any amendment leading to a higher package value will require payment of the price difference.

7. Travel Insurance

Customers are strongly advised to purchase comprehensive travel insurance, covering trip cancellations, medical emergencies, and personal liability. Sail & Stay Privé is not responsible for any costs resulting from unforeseen incidents.

8. Health & Safety

  • Customers must comply with safety instructions provided by the skipper or crew.

  • The skipper’s authority on board is final and binding on all safety matters.

  • Customers with pre-existing medical conditions should inform the Company before booking.

9. Photography & Promotional Use

By participating in a trip, customers grant Sail & Stay Privé permission to use photos and videos taken during the experience for promotional purposes (website, social media, marketing materials). Personal data (faces, voices) are used only for marketing with discretion. No images will be sold or used beyond the Company’s promotional activities. If a customer wishes to opt out, they must notify the Company in writing before departure.

10. Liability

The Company’s liability is limited to cases of wilful misconduct or gross negligence and shall in no event exceed the total booking amount paid. The Company is not liable for personal injury, illness, loss, or damage to personal belongings, except where caused directly by gross negligence of Sail & Stay Privé. Clients are responsible for any damage caused to the vessel due to negligence or misconduct.

The Company accepts no liability for delays, cancellations, or changes caused by third parties (e.g. ports, port authorities, airlines).

These Terms and Conditions are subject to change. The latest version will always be available on our official website.

These Terms and Conditions are governed by Swiss law. Jurisdiction is Canton Zug unless otherwise agreed in writing.
